Cost Transparency – SRA Transparency Guidelines.

As per the recent guidelines set by the SRA. All legal firms must showcase their fee structure based on the service provided to the client.

Below is a fee guideline of our set services.

Immigration

TEAM

The Immigration team consists of:

Please note that we work on a fixed fee basis. This depends on the type of case and the complexity of the case based on each client.

Application for leave to remain

A note on value added tax (VAT) – All the figures given below include VAT charged at 20% unless specifically stated. However, charging VAT in relation to immigration matters may depend on where you live and what immigration permission you have. We will confirm whether VAT (at a rate of 20%) is payable when you instruct us and we can work out if VAT is properly chargeable.

Disbursements are costs related to your matter that are payable to third parties, such as visa fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. Usual disbursements for an immigration case would be £200-£500 inclusive of VAT, where applicable, however this can vary. The following are usual disbursements for the process:

Independent expert reports e.g. medical experts. These are not required in many cases: we will let you know as soon as possible if we consider an expert report is necessary.
If there is an interview and we do attend with you, there will be additional disbursements in respect of our mileage/travel expenses.

We will normally be able to submit this type of application in a short period of time depending on the evidence required and the length of time it may take to obtain the evidence of you instructing us, but we will let you know at the earliest opportunity if it is likely to take longer than this.

Please note the anticipated length of time and fees are an estimate based on the facts above. All applications are likely to vary and of course, we can give you a more accurate estimate once we have more information about your specific case.

Appeal and Administrative review costs are not included in the fees.

We usually charge on a fixed fee basis. Our rates range from £1,500 to £2,000 fixed fee not including disbursements i.e counsel fees. This is at the First-tier Tribunal only. Further fee will be required should the appeal proceed to the Upper Tribunal etc.

When someone passes away it is often necessary to obtain a Grant of Representation to obtain the authority to deal with the deceased’s assets and liabilities whether or not a Will had been made.

Instructing a solicitor with specialist knowledge of the process required to wind up an estate can help you at this difficult time. What are the legal costs?

Applying for the grant, collecting and distributing the assets

We anticipate this will take between 12 and 16 hours work at £295 per hour plus VAT at 20%. Total costs estimated at 4750 ( plus 20% VAT). This work will be carried out by Ali Ebrahim. Ali is the only solicitor listed in this section.

The exact cost will depend on the individual circumstances of the matter. For example, if there is one beneficiary and no property, costs will be at the lower end of the range. If there are multiple beneficiaries, a property and multiple bank accounts, costs will be at the higher end. Costing will also depend on the complexity of the matter and in certain circumstances a value element will be added. If a value element is added the client will be advised specifically in the client care letter.
It may be possible to agree on a fixed fee for administering a simple estate and this could typically range between £2000 and £3,500 (excluding VAT) depending on the circumstances of the estate and the seniority and experience of the person responsible for the work.

We will handle the full process for you. This quote is for estates where:

There is a valid will
There is no more than one property
There are no more than 5 banks or building society accounts
There are no other intangible assets
There are no more than 6 beneficiaries and they are identifiable and traceable, and no trust is required (such as for a minor or for a vulnerable person)
There are no disputes between beneficiaries on division of assets. If disputes arise this is likely to lead to an increase in costs

Potential additional costs

If there is no will or the estate consists of any share holdings (stocks and bonds) there is likely to be additional costs that could range significantly depending on the estate and how it is to be dealt with. We can give you a more accurate quote once we have more information.
If any additional sealed copies of the grant are required, they will cost £1.50 (1 per asset usually).
Dealing with the sale or transfer of any property in the estate is not included.

How long will this take?

On average, estates that fall within this range are dealt with within 6-9 months. Typically, obtaining the grant of probate takes 8-12 weeks. Collecting assets then follows, which can take between up to 8 weeks. Once this has been done, we can distribute the assets, which normally takes up to 4 weeks.

What if my matter is more complicated?

If a full inheritance tax account is required or there are other reasons why the estate is more complicated, our hourly charging rates will apply and the costs will depend on the complexity and the work which needs to be completed. It is important to provide us with as much information about the estate as you can at the outset so that we can try to provide as accurate an estimate of our costs as possible prior to commencing work.

Possible complications include:

· Multiple beneficiaries, including those that are charitable, resident overseas, under 18 and/or vulnerable;

· One or more of the beneficiaries cannot be located, whether under a will or an Intestacy;

· There is more than one property, a life interest in a property, and/or investment properties;

· Inheritance tax is payable;

· An application for the Residence Nil Rate Band inheritance tax relief is required;

· A trust is created in the Will, or arises in respect of a minor beneficiary;

· There are shareholdings with more than one share registrar

· A deed of variation is being entered into to vary the beneficial entitlements;

· The estate has an international element, for example: the deceased was non-UK domiciled or there is a query over their domicile status or owned assets in another jurisdiction.

What if I want to do some of the work myself?

· If you would like to obtain valuations of all the assets and liabilities in the estate and to deal with the administration of the estate yourself but would like us to prepare and submit an application for the grant of representation on your behalf, then provided that a full inheritance tax account is not required and we do not have to communicate with any third parties other than the Probate Registry, the work would be carried out at a fixed fee of between £2000 (excluding VAT) and £3500 (excluding VAT) if it is not necessary to transfer an inheritance tax allowance from the deceased’s spouse. If it is also necessary to apply for the transfer of an unused inheritance tax allowance from the deceased’s spouse, the cost would be £1,500 plus VAT.

As part of this fixed fee we would:

Identify the type of grant required and the documentation required to enable us to complete the paperwork to apply for the grant

Complete the return of estate information form;
Draft the statement of truth for you;
Complete any necessary form to transfer the inheritance tax allowance of the deceased’s spouse

Stamp Duty or Land Tax (on purchase)

This depends on the purchase price of your property. You can calculate the amount you will need to pay by using HMRC’s website or if the property is located in Wales by using the Welsh Revenue Authority’s website. All clients are advised to obtain independent financial advice on their own tax affairs.

How long will my house purchase take?

· On average, it can take between 8-16 weeks to reach an exchange of contracts on a simple purchase of an existing freehold from when a client has retuned their forms and their ID has been verified and from when we receive a complete draft contract pack from the seller’s solicitors. Timescales can depend on the specifics of each transaction.

· Leasehold properties tend to be more complicated than freeholds and can take longer as a result. Additional timescales can depend on the specifics of each transaction.

· New build properties can take 8-16 weeks to reach an exchange of contracts but completion may not take place for many years. Timescales depend on the specifics of the transaction.

Stages of the purchase process

The precise stages involved in the purchase of a residential property vary according to the circumstances. However, below we have suggested some key stages that may apply to a simple freehold purchase:

· Paying off existing mortgage and accounting to you for sale monies

Non-standard transactions

We may charge different fees for cases that have particular features or complications. For example:

· Auction purchase. Typical additional charge will be 25% of our usual fee

· Unregistered title Registration of tile. Typical additional charge will be 50% of our usual fee with a £1000 plus VAT minimum.

· New build properties. Typical additional charge will be 50% of our usual fee.

· Islamic mortgage. Typical additional charge will be 50% of our usual fee.

· Help to buy. Supplement £350 plus vat

· Help to Buy ISA. £50.00 plus vat

· Shared ownership. Supplement £250 plus vat

· Purchase of repossessed property. Typical additional charge will be 50% of our usual fee.

· Lease extensions and variations. Fees dependent on terms and complexity.

· Buy to let mortgages by specialist lenders where fees depend on the specifics of the lender’s requirements.

· Overseas identity requirements (£250 to £500 plus vat)

· Documentation for Gifts of deposits (typically £250 plus vat)

· Personal loans (typically £500 plus VAT)

· Dealing with defective titles

* Our standard fees assume that:

this is a standard transaction and that no unforeseen matters arise including for example (but not limited to) a defect in title which requires remedying prior to completion or the preparation of additional documents ancillary to the main transaction
if leasehold, this is the assignment of an existing lease and is not the grant of a new lease
the transaction is concluded in a timely manner and no unforeseen complication arise
all parties to the transaction are co-operative and there is no unreasonable delay from third parties providing documentation
no indemnity policies are required. Additional disbursements may apply if indemnity policies are required.
